These Terms and Conditions ("Terms") govern your use of our eCommerce platform. By continuing to use our services, you agree to these Terms.

1. Overview

Finechef Kenya is an online marketplace where customers can purchase goods sold by both Finechef and approved third-party vendors. We facilitate transactions, manage the platform, and provide customer and vendor support, but we do not own all products listed on the site.

2. User Accounts

a. Registration

To use the platform, you MUST create an account with accurate, complete, and up-to-date information. Users must be at least 18 years old or have legal capacity to enter into agreements.

b. Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials. Any activity under your account is your responsibility unless proven otherwise.

c. Account Suspension or Termination

We may suspend or terminate your account if you violate these Terms, provide false information, or misuse the platform.

3. Role of Vendors

a. Vendor Listings

Approved vendors may list products for sale. Each vendor is responsible for:

- Providing accurate product descriptions, prices, and availability.

- Managing inventory.

- Fulfilling and shipping orders on time.

- Handling returns and customer queries related to their products.

b. Vendor Agreements

All vendors are bound by a separate Vendor Agreement, which includes service standards, payment terms, and compliance requirements.

c. Vendor Accountability

Finechef may mediate disputes but is not liable for vendor product performance, warranties, or delivery timelines.

4. Orders and Fulfillment

a. Order Process

Orders go through these stages: Pending, Confirmed, Processing, Out for Delivery, and Delivered. Therfore, Once an order is Confirmed, it cannot be canceled by the customer.

b. Availability and Pricing

Prices and availability may change without notice. In case of an error in pricing, Finechef reserves the right to cancel the order and notify the customer.

5. Payments and Fees

a. Customer Payments

Customers shall pay via via the provided payment methods on the platform. The total amount includes product cost, applicable taxes, and delivery charges. Additional fees maybe applicable where third party delivery is involved.

b. Vendor Payments

Vendors receive payment after successful order completion, subject to commission and payout terms outlined in their Vendor Agreement.

c. Payment Disputes

Payment issues should be reported within 7 days. We'll assist in investigating and resolving any concerns.

6. Shipping and Delivery

a. Delivery Time

Estimated delivery times are shown at checkout. Delays may occur due to location, stock, or vendor-related issues.

b. Delivery Responsibility

Vendors are responsible for timely delivery unless the product is fulfilled by Finechef.

You agree to use Finechef Kenya’s Platform lawfully and respectfully. Prohibited behavior includes:

- Fraud or impersonation.

- Posting false or misleading content.

- Disrupting platform operations.

- Attempting unauthorized access to other accounts.

7. Intellectual Property

All content on Finechef, including logos, design, text, and software is the property of Finechef Kenya or its licensors. You may not use, copy, or distribute our materials without written permission.

8. Privacy Policy

Your use of Finechef is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data.

9 . Limitation of Liability

Finechef is not liable for:

- Any direct or indirect loss from using the platform.

- Delays, failures, or actions of third-party vendors.

- Issues arising from inaccurate user or vendor information.

We do our best to maintain a secure, functional platform but make no guarantees of uninterrupted service.

10. Changes to Terms

We may update these Terms at any time. When we do, we'll post the new version on our website and update the "Effective Date." Continued use of the platform means you accept the changes.

11. Governing Law

These Terms are governed by the laws of Kenya.
